Fabryka.API

Fabryka AI service terms

Version dated 29 October 2026.

Current data handling: synchronous and streaming /v1/chat/completions requests use application-level Zero Data Retention (ZDR), including requests made with free API keys. Prompt and response content is not stored in the operational request database or the free prompt collection and is not used for model improvement. Batch jobs and demo endpoints have separate retention rules. Fabryka Commons remains a proposal: enrolment, example contributions and rewards are paused, and the proposed allowance of 10 million tokens is not an active offer.

Provider: Kacper Wikiel, a sole proprietor trading as Fabryka AI, Aleja Jerzego Waszyngtona 12/14 lok. 40, 03-910 Warszawa, NIP 9522079063, REGON 542074504, email: k.wikiel@gmail.com.

1. Service

Fabryka AI provides synchronous and asynchronous API access to Bielik 11B v3 and Qwen3.8 27B models. Output is generated by an AI model, not a person. The model list may change; /v1/models returns the current list. See also the AI Act notice.

The free API is not intended for confidential, sensitive or personal information. Do not submit secrets, health information, customer databases or other sensitive personal data.

2. Keys and accounts

  1. Using the service requires internet access and an HTTPS/JSON client. An anonymous test key does not require an email address.
  2. Free API is intended for compatibility testing. Free test keys and demos subject to the free product's daily allowance have a limit of 10 generation submissions per day for their assigned identifier. The counter resets at 00:00 UTC; it includes submissions even if the model later fails, and counts each batch item separately. Allocated credits, shared capacity and model limits also apply. ZDR does not mean unlimited access.
  3. Users must protect their keys. Creating multiple keys to bypass limits or disrupt the service is prohibited.
  4. A named account requires an email address, a password and acceptance of the documents. Account closure may be requested by email.

3. Processing requests

  1. The API accepts jobs, assigns identifiers and returns status information. Size limits follow the current API specification.
  2. A synchronous endpoint returns its result over the same connection. Batches run in a queue; the window indicated in the API is an operational target, not an availability guarantee.
  3. Current application-level ZDR covers new synchronous and streaming /v1/chat/completions requests, including requests made with free API keys. Content is processed in memory; prompts and responses are not stored in the operational request database or the free prompt collection and are not used for model improvement. No separate data-policy acknowledgement or special privacy header is required; the HTTP 428 gate associated with that acknowledgement has been removed. ZDR concerns content, while account, billing and operational metadata are still retained. This is the current, temporary mode of operation for chat completions; it does not claim deletion of previously stored content or an independent infrastructure audit. Batch jobs and demo endpoints require data storage to process jobs and are outside this ZDR statement. Their working request content is deleted when a job completes, is cancelled or fails; a stored result is deleted on the first successful retrieval. The threshold at which uncollected results become eligible for automatic deletion depends on the service configuration. By default, a result becomes eligible 24 hours after job completion; deletion takes place during the next cleanup cycle. Content collection for the free model-improvement programme is disabled across all endpoints. See the privacy policy and data controls for details.
  4. Processing may take place on external GPU infrastructure. Without separate arrangements, do not submit secrets, special categories of personal data or other people's data without a lawful basis.
  5. A model may return an incorrect or incomplete answer. Verify output before using it in decisions with significant consequences.

4. Prices and balance

  1. The prices applicable to a request are displayed in the service or API. Amounts are expressed in USD and charged to the account balance.
  2. After processing, the charge is calculated from the actual input and output token counts reported by the inference engine. max_tokens is used to check the possible cost; it is not an automatically billed token count.
  3. The system may reserve balance up to the maximum possible cost. A job that is not executed is not charged.

5. Content rights and permitted use

You represent that you have the rights and permissions necessary to submit Content and permit its processing as described in these Terms. Do not submit other people's personal data, confidential content or protected material without the appropriate permission. This representation does not remove Fabryka's data-protection obligations or the statutory rights of users and other people.

Users are responsible for the lawfulness of their content and their use of output. Unlawful content, infringements of third-party rights, malware, phishing, attacks and bypassing safeguards are prohibited.

Content from requests covered by the stated ZDR scope, whether free or paid, is not used to develop, train, fine-tune, evaluate, benchmark, test or improve models. New example contributions to Fabryka Commons are paused. Resuming the programme, allowing data contributions and any research or model-improvement use would require the terms to be presented separately and the user to make a choice; they do not follow from using the current API. The data controls and privacy policy describe the current processing scope. Changing the current, temporary mode of data handling requires advance presentation of the new rules; it does not automatically expand the scope of previously concluded agreements.

6. Availability and changes

The service may be temporarily unavailable because of failures, maintenance or a lack of GPU capacity. Traffic that threatens security may be restricted, and a key used in breach of these Terms may be blocked. Material changes affecting existing users will be communicated in advance.

7. Complaints

Send complaints to k.wikiel@gmail.com, including the job identifier, a description of the problem and the expected resolution. A response will be provided within 14 days. This does not limit statutory consumer rights.

8. Consumers

A consumer may withdraw from a distance contract within 14 days. If a paid service began earlier at the consumer's express request, a proportionate payment for services already provided may be due on withdrawal. A withdrawal statement may be sent by email or post.

9. Liability

The provider is liable in accordance with the law. Users are responsible for decisions based on unverified output. In relation to business customers, liability for lost profits is excluded and liability for ordinary negligence is limited to the fees paid in the preceding three months; this limitation does not apply to liability that cannot lawfully be excluded.

10. Governing law and disputes

Polish law applies, without depriving consumers of protection provided by mandatory legal provisions. Court jurisdiction is determined by law.
